Today, Montgomery County Clerk of Courts Mike Foley dismissed his civil stalking protection order case against me. The case, Foley v. Esrati (2025CV05807), was filed October 21 and voluntarily dismissed on November 12, 2025, according to a notice filed by Foley’s attorney, Dennis Lieberman, under Ohio Civil Rule 41(A)656679659 Notice of Dismissal.
This comes after Foley’s allegations were promoted in a front-page story in the Dayton Daily News and then followed up with a sizeable story on page 2 a week later. There was also a three-and-a-half-minute segment on 22/45 News with Jenilee Borek. Those reports repeated his claims that I had threatened him, even though the court denied his request for an emergency protection order and no such order was ever issued. Then, despite being terrified for his life, he filed a continuance on the hearing.
He had also filed against former employee Tyler Starline and caused him financial damage through attorneys fees- and being sent home from his job at the Board of Elections. I have no information on if Lieberman has also dismissed that case. It’s been dismissed as well. See Press Release below.

The filings in the case are hidden from public view, but I can confirm there were multiple procedural filings before Foley abruptly withdrew his petition. The dismissal occurred before any hearing on the merits could take place.
The episode caused reputational harm and unnecessary legal expense. I had to hire an attorney to respond to a case that never should have been filed in the first place.
Separately, I am preparing to appeal the Second District Court of Appeals’ decision in my Quo Warranto case to the Ohio Supreme Court. That case seeks Foley’s removal from office based on his conviction and subsequent withdrawal of his plea in the ongoing criminal matter scheduled for trial in December. It is a question of Ohio’s Constitutional requirements not being fulfilled by the Ohio Revised Code.
Justice takes time. But the truth, and the court record, will stand on their own.


Yet you, David, support someone who pulls the same crap as Foley– filing bogus civil lawsuits and getting questionable criminal charges filed.

Congratulations, David! A dismissal with prejudice would have been better, but perhaps Foley’s criminal trial will do the trick once and for all.
